28 1 An Introduction to Equity ‘[I]t will be salutary for the lawyer to remind himself that equity is the appendix that the Chancery was composing for the saving of the common law, and is not an independent system of law.’ This remains true of Equity today. It is not an independent system of law, but it has a distinct identity and function to modify the rigours of the Common Law. We have seen examples of this throughout this chapter, for example the distinct but complementary role for equitable remedies, and other examples will be identified throughout this book.
